No I don't think so. most debt that both are responsible for has to be incurred together. but you could always call the IRS and ask them.

Yes, you are responsible for the taxes if you file joint. Lets say your spouse owes ten thousand dollars in back taxes and you file a joint return and are going to get three thousand dollars back, that money will go straight to the balance of your spouse. If you file separately than I believe they will not keep your refund. If your spouse owes taxes than file your own taxes.

I got married at 20, my husband is 7 years older than me...Before we got married he owed two yrs. worth of back taxes...Once we got married the IRS put my name on it too. So even when I got tax returns they took my money and they sent bills to both of us seperatley. So yeah...even though I don't think you should be responsible...the IRS apparently does!

No, but their debt can substantually stress your marriage because she is still obligated to pay and the IRS doesn't like to wait.

He can just declare bankruptsy, guessing it is a guy, they all lie and cheat. Ask my X-husband. CPA
