That a drunk driver who kills a woman and her unborn baby gets 2 murder charges? Even if the woman was on her way to have an abortion!?!?!? Why is it legal for her? But not the drunk? Dont get me wrong i am TOTALLY against drunk driving and believe their punishments should be stiffer. But why can a woman abort a kid and its not murder, but a criminal that kills her and the baby dies gets 2 murder charges?!?!!?

Because abortion isn't illegal and 1)drunk driving is 2)running someone over also is (assuming she was a pedestrian when she was killed) Who says she was going to get the abortion? That's hearsay in the courts eyes. Vehicular manslaughter done by a self intoxicated incoherent person versus an individual woman making a conscience and personal decision are two different things. I see your point though, don't get me wrong, but the two situations are two different comparisons regardless if murder is murder. That doesn't make it ok though, I understand that. A woman could just as easily give the child up for adoption if she decides she doesn't want it, or just as easily keep her legs closed if she doesn't wan to go through pregnancy. What about rape and incest? Where do those to factors come in to play? Just saying is all. Well, take care :)
Premeditated murder v.s. Manslaughter, I get it I get it....still, you can punish someone for a crime that they commit because it's a CRIME and illegal. Unfortunately you can't punish someone for a moral and unethical "crime" when it's not illegal. Morally though, I see your point, but it's a tricky situation...

Also, in my opinion, if the abortion has not yet taken place, and the child was still inside the womans body when the deaths occurred, then why shouldn't the driver get charged for the murder of the baby? The woman had not yet committed any type of crime and at the time was still innocent, despite her alleged intent. Once again, I still see your point, but there are different moral aspects to each individual stories. You have to take every aspect into consideration. For instance, you could say it would be ok to charge the driver with double homicide if the mother was not going to get an abortion, and don't charge the driver with it if she was going to have an abortion. If you knew for a fact that she was going to get an abortion, who's to say she wouldn't have changed her mind at some point? Is it ok for her unborn child not to be justified in it's death as well if there is a possibility that it wouldn't have been aborted? Reasonable doubt. You have to think of every different perspective in every different situation. So basically what I'm getting at is, I myself wouldn't get an abortion, and I definitely don't think it should be used as a form of birth control, but if a soon to be mother and her unborn child are killed bye another careless person than why not be charged for both deaths? Why I don't think it's the same difference as when the mother aborts is because you never really know why a woman will get an abortion. She may have been raped, or incest may have taken place, you never know. I don't think women should go, "oops, I'm pregnant," and have an abortion. There is no oops, keep your legs closed. It's just like how I can't break property that belongs to you, but you can break your own property if you want. It seems to imply that the fetus is the woman's property. So it's understandable that the woman could abort it, but another person couldn't kill it without her permission. Although if she's allowed to abort it because it's not considered a life, then it seems like the drunk driver's charge should be destruction of property, rather than murder.

I would guess because the law presumes she intended to keep the child and prosecutors tend to try to get the harshest penalty possible. A similar situation would be a person hauling furniture. He may be taking it to the dump, but a person who steals or destroys his furniture before he gets there is going to be charged with a crime.
No, fathers do not have a say over what happens to the woman's body. It is the mothers right to choose because the legality of abortion is based on the idea of a right to bodily privacy. I can not be forced to donate blood against my will, even when another person's life is at stake, and similarly, even if the fetus is a person, the mother cannot be forced to donate her body against her will. Since it is not the father's body, he gets no right to determine what happens.

So what she was preg.. at the time of the accident...the courts would rule it a double murder.. doesnt matter if she intended to abort.. that is after the fact. 2 lives that a drunk killed but she hasnt had the abortion. Now there you go. The matter is pro choice for the mother... is it pro choice to get drunk and kill at ran-dim?

hmm i think the drunk driver should be punish same as the women who get a abortion since both are committing murder Cause i women should never abort a baby unless is for a good reason if u cant have baby than protect ur self Lmao my opinion on abortions

I guess because you dont know if that lady ever planned on aborting. It is not someone Else's decision, dont get me wrong though, I dont agree with abortion neither. But It is not someone Else's decision to decide if your going to lose you life or if your child will lose theirs. I do see what your saying, basically murder is murder, and murderers all alike should go to jail. The thing is though, you dont know what that woman was planning with her child. It is not your decision to make. Dont drink and Drive, it does not only effect you..

Because he can not claim the right to control her body. And, whether you like it or not, the right of a woman to control her body is the argument for abortion. I don't agree with it in my heart, but you can't argue that the man just saved her a step. That would be ludicrous.
