my so called aunt has a picture of me from 2 years ago when i was 19 and now i am 21 drinking at a pigroast and i was wondering if she could use that against me so i wont get my son back?

Statue of Limitations only applies to the ability to bring a criminal charge or civil action against someone. It does not relate to how long after the fact a picture can be used as evidence in a court room.

The only "evidence" of your underage drinking is the picture. Even if it shows a date it is not very conclusive. As such it is highly unlikely the police would pursue

If she is a witness against you in a hearing concerning your fitness as a parent the court MIGHT allow it. If you have a decent lawyer he could most likely get the picture excluded as evidence.

There is not a court in the country that would prosecute you for a picture that is two years old. I'm guessing they would all have a good laugh after she left.

As far as your son is concerned, the courts will not consider any wrongdoing when making a decison on custody, unless it has an effect on the childs welfare. Drinking at a pig roast two years ago does not put your child in danger, and you have nothing to worry about.

The court would laugh at her if she did.

A picture of a person with a beer in their hand does not proove that person was drinking, without reasonable doubt.

I quit drinking 2 years ago and my friend just tok a similar pic of me to show others (in jest) the drink was for my g/f

No, not at all. First of all, there's no way of proving what you're drinking, even if the can says something. Second of all, there's no way of proving where it's located.

College students very often post pictures on the internet of themselves drinking. It's no big deal.
