This money hungry woman wont leave the house, she never had to work and now is saying since they are divorcing (not final yet) she cant take care of herself and doesnt thik she should pay for her cell, ins, gas, etc... she has a lawyer and he tells her she can stay in the house but he wants her out, it's her own fault she cant take care of herself, he has custody of their daughter and his son from another marriage... any suggestions to get her out legally??

Your question sounds biased toward the husband. If she's been a stay-at-home mom, then her resources are truly limited. The husband should have foreseen this.

She is allowed to stay there until the divorce is final. After the divorce is final, if they didn't have a prenuptial agreement and they own the house, then they will have to sell it and split the proceeds. Or they could buy the other one out of the estimated value. If she was a stay at home mother and wife, and has never worked she will probably be entitled to alimony until such time as she can take care of herself in the same way her husband did during their marriage. Since the father has custody of their child she will be forced to pay some sort of child support, so that may negate the alimony. Not really sure how that works exactly. Im a stay at home mother that has never held a paying job. I can see where it might be difficult to jump into the job market but I can't see just sucking the life out of someone else just so I wouldn't have to work. She needs to grow up a little and be an adult for a little bit. Since the man has custody of the child that shows that maybe she wasn't doing that great of a job at staying home. It kinda sounds like she was just sitting at home with no purpose. At least in my case I care for my four kids, care for my home, and my husband. Hope things end up working out for everyone in this case. The children, sadly, are probably going to suffer the most in this.

Legally you cant get her out its her house and not her its that he never had her work and now at a drop of a hat wants her to move on after being a wife and mother thats a job and your paid for that by your husband do you think a clean house and bills paid for you and all the things stay at home moms do is free . Hes going to have to pay her cell and exc its still his bill after their divorced thats the way the law work. Alimony
Suggestions he needs to get a new place....

This one is a difficult one. According to law she will get half of what they accumulated together since marriage. Then the court will have him pay child support and possibly alimony. The mother always gets the children unless the father can prove she is incompetent. He should get a lawyer as soon as possible to review his options as to carve out a strategy.

It's her house......and she can stay as long as she wants too until the divorce is final.....why do you care anyway are you the other woman?
Who cares if she works or stay home it's her right and he allowed her to stay home and he agreed to take care of her til death do they part but has decided to part for some reason that you are leaving out.
If her name is on the deed or not.....here in America she owns 50% of that house......so leave it alone and Mind your Own Business.

Until the divorce is final, he can't make her go anywhere. He let her think it was ok not to work etc when they were married. So I'm sure her lawyer will get a kick for his money in court.

since they are married and if they live in a community property state, the onlu person who can make her leave is a Judge. if he owned the house prior to the marraige to her he will be entitled to keep the house. if they bought it together, she is entitled by law to half of the value.....Got news for her though....she better figure out how to take care of herself, since he has custody of their child she WILL be ordered to pay child support

If she is not causing domestic violence or other problems, she is allowed to stay put.
The guy married her, so he has to put up with whatever the law says until such time they are divorced. And he will probably survive

its actually her right to stay there until the divorce is final. its due to the fact that he can say she abandoned things and shouldnt get them. she is also preventing him from selling things in order to not give them to her. if he let her not work, he will need to pay alimony usually. in all fairness, she will have to get a job and take care of herself.
