I am starting up a small photography business. I do not expect to make more than $5000 annually. Since I am the sole propeitor do I need an EIN?

You only need an EIN (Employer Identification Number) if you are an employer, as in, employing other individuals. In my experience, if you will be claiming your income with the IRS as small business income, there is no need to have an EIN. You should, however, register your company with the state in whatever capacity your state requires.

Depends on the state. I had to get an EIN for doing a show in Chicago (I'm not from Illinois). But I didn't need one for Pennsylvania or Wisconsin.
