If someone in your company secretly promoted an individual (including sending them to training) before they even posted the new position whilst not giving others the opportunity to apply for it, is it against the law?
I know it is with federal employment, but what about private companies?

A private company can promote whomever they see fit...and are not obligated to post the opportunity at all

Without a labor contract specifying promotional opportunities are a condition of work, you have no say or choice in promotions, creation or elimination of jobs.

You work at the will of the employer except for the legally recognized discrimination ( Religion, Race, Ethnicity, etc.)

If company policy is to post open jobs, I would talk with your HR rep. There would be no reason to post jobs if the selection was already made.
