i have a friend that is staying with me because her and her husband separated for now but make a long story short he caught her cheating with an ex he didn't walk in on them he just saw some e-mails they had been sending to each other so he was mad as hell he told her to leave they have 3kids together 1 she had before they met and her and hubby has two together now he wants to take his two kids from her and try and prove her an unfit mom she does't work she is stay home mom has been for the 9yrs they have been married i want to help but i don't know anything about legal matters should has this i told her maybe she should get a job or even go to school then when he does try to take them maybe a judge will see that she is working and trying and he can't get them he works all the time so he doesn't have time to take care of them thats why she doesn't work thanks to anyone that can help

Your friend should see an attorney. It depends on the jurisdiction but custody decisions are usually based on what is in the best interests of the children so being a stay-at-home parent shouldn't count against her. Her husband would usually have to pay child support for their children if she has custody of the kids.

She will need to show the judge that she will be able to take care of them financially. If she has a job that will look better than if she doesn't. She also needs to find a place to live that is large enough for her and the kids so she can show that she has a roof over their heads. She can't get into any trouble with the law through this time too. Above anything else she needs to see a Lawyer immediately. Her rights need to be protected and a Lawyer that is on her side is the only way that it will happen. Good Luck

well unfortunately I know way to much about this matter: It is hard to prove a mother "unfit" and getting a job always looks better to a judge ,,,cheating is bad but it doesn't prove you unfit,,,,I'm not sure where you live but there's usually a "legal aid" in every state the sooner she gets an attorney the better,,,all you can do is be a friend, but it sounds like you already are,,,good luck to her

where is this guy that she was cheating with? i hope hubby does get the kids
your friend has character issues
husband works and this is the thanks he gets-he probably BOUGHT the computer she was emailing this new honey on....
I hope YOU dont have a husband...if so be prepared for hard times in your own marriage since you are classed by the company you keep!
This woman is not faithful to her own husband can she really be trusted with yours?
get her out of your house
let her work out her own mess (that she caused)
If a guy had done this to her you would be circling the wagons and screaming what kind of dog he was

before one thinks of cheating there have to think of the other parties involved such as their kids. kids are affected very badly. one should not think of their selfish desires, as one loves their kids why cheat on their father, what will they think of you as a parent, your child may never trust a parent again. they will grow up with fear of loving and being loved by someone else

She needs to talk to he attorney about her legal rights. This could get complicated because of her being unfaithful.
