A state representative in Congress IS considered a federal employee. They just have different retirement plans than other federal employees. So they are, but they aren't.

A Member of Congress, whether a member of the House of Representatives or a Senator, is a sworn, commissioned officer of the United States. The staff members who work for them are government employees.

A State Rep is a state employee. A Member of Congress is a fed.
