A domestic partner is someone you live with and can be of the same sex. A common law spouse is of the opposite sex and you have to be living together for a specific number of years. It varies by state.

In my country? Nothing. There is no difference between, common law couples, legally married couples, domestic partner and same-sex couples, well except divorce. Divorce is for the legally married only. I call my fiance, my partner and will probably continue to do so after we are married.

Common law refers to a common law marriage. An unofficial marriage that is legally a marriage as a result of living together for a set amount of years. However, many states no longer recognize common law marriage.
Domestic partnership refers to two people, romantically involved and living together.

In my opinion, domestic partners are couples living in together under one roof but is not binded legally as in they are not legally married. No certificates or whatsoever to prove their "union". Whereas common law spouse stands that they are couples that are legally binded as in they are legally married by church and state.

I think common law has to do with the number of years you've lived with someone. It varies from state to state, though.
