New employer doing background check on me, so they called my current employer asked for my current salary. My HR personnel released my salary information to them. My offer will be lower than I am asking for. Is my HR rep violated release my personal info to other? Can I sue my company?

It depends on which state you are living in. Some states do not allow disclosing current and/or former employees' salary info. Check with your state's labor rules and regulations.

Yes, they are allowed to release your salary info.

Contrary to popular opinion, there are no state or federal laws, regulating what a previous employers can tell a prospective employer.

As long as everything they say, is truthful.

Now most companies only provide dates of employment and some will also provide the last salary.

But, that is their choice to only provide that info, most do so, to limit exposure to law suits.

But they can give your employee evaluations, any displinary actions taken, etc, if they want to.

I believe that was a violation of your rights. I don't think they can release anything, but your working abilities. Talk to a lawyer anf find out if your rights where violated

You can't prevail; salary information is often shared under such circumstances.
