I have a letter from my lawyer stating that I wish to separate from my husband. I am going to deliver it to him myself, and wondered how long it is valid for? Is there a period after which it expires? I am planing to wait until the end of the month before presenting it to him. It was dated Oct.1/07. I guess my question is: how long can I delay before it is no longer any good?

Hi...A letter of intent is just that. It is an intent. It means that this is what you plan to do. It is kind of like a heads up...Hello HONEY, I intend to separate. It is not a legal document. It is just a letter. Having your attorney write it rather than you lets the guy know you are serious and you have an advocate. An advocate, someone on your side, looking after you. You can give it to him when ever you want. The later you wait the more you husband will realize you were pondering and maybe you are unsure of your intent. So the longer you wait the more important it is to let him know why the delay. I wish you the best and if you want to talk more about the underlying reasons why. In the eye of the laws in M'sia is only 2 years of separation. Therefore, it is always advisable to give ample time to counter unless you have other intentions but otherwise is better to give proper and descent time.

During this period, you have to go for counselling with the Marriage Tribunal to certify your "irreconcilable differences" for 3 times within 6 months and finally the tribunal will give a "verdict" prior your final divorce proceeding.

After which (the divorce), there is another 3 months' cooling period in after which you can remarry another.

I am not a lawyer, but unless it has a date, it should be an open ended letter of intent. A quick question for the attorney, but I would say that you have plenty of time!

That depends on which state you are in.

Also, you are better off having process server make the delivery.
