Ok , heres the story in a nutshell . My sister is taking my father ( who is in his 60's ) to court because she says he is molesting my son who is 16 . Now me and my father and my son all know this is totall bull , my father is a good man and my son has a girlfirend and would never let anyone touch him . But she wants my son to get taken away from me , and i dont know why . This is tearing my father apart because he loves his grandson very much . Do you think she can get very far without any evidence at all..... and if so , why?

i want to thank everyone for their answers . And to answer some of your questions , my sister is a drunk who calls up everyone in the familly at 1 am to tell them a bunch of bull about other people in the family and not just my dad...

Ok, here is what I think, in a nutshell. HAHA
Your father will obviously deny it, guilty or not. Your son with also deny it, because he is 16 and doesn't want anyone to know about it because he will be totally embarrassed if anyone found out. How does your sister know this? Has she seen it happen? Has your son told her things? Does your sister hate your father? Even if she did, why put your son thru it all? Does she not care for your son? Does your sister not like you either? There has to be a specific reason why your sister wants your son taken away from you. Something must have happened and you are denying it too. If you guys live in a state where you have to be 18 to be an adult, yes, your sister can pursue this because your son is considered a minor then. If your sister goes ahead with it, it will be public knowledge for ever. I believe she can start a case against your father only if your son is considered a minor.

There has to be some kind of evidence before it can go any farther- If your sister does get it to court then all they will do is ask your son if it's true or not Son tells them no and chances are it will get dropped. Let your sister look like an *** in court. You walk out the better person.

Probably social Service s is involved? what have they said so far?
You may not wnat to hear this, but this type of issue your father is accused of cuts across all generations and socio-economic levels.
So do motivations for making false charges, including possibly mental illness, so that is why there is an investigation.
If this has already reached the level of a court hearing, it is well past the time to have hired an attorney to represent you and your son, and your father too. Get on it!

Is she saying she was molested too? You might want to find out why the anger is so strong towards you dad? My sister has said some things my dad has done to her, and other family members. But I had never seen anything when I was growing up? I really feel for your situation.. I hope you can find a way through this time.

Your son is at the age to tell the truth . If she is filing a false report , she can have charges against her brought up by your Dad and son . Why is she doing this again ? Is she raising your son ? Stand your ground and make sure your son tells the truth .

You said your son is 16? Then unless he is mentally incompetent how could she do this? that is crazy. I mean crazy. What does she stand to gain in doing this ? Is your father legally competent? If so, I would sue the heck out of her for slander and get a restraining order to keep her away from my son and my father! Your father would have to do it himself but you would for your son.GO TALK TO YOUR ATTORNEY WITH YOU AND YOUR DAD AND SON NOW!

if she actually makes the complaint then social services has an absolute obligation to investigate and "special victims unit" will come to talk to you. As long as the child lets them know the truth then you should probably be alright. They'll probably report that the complaint was "unfounded" and leave you alone. I've seen this happen a couple of times...people can be so cruel!

I don't think she can take him to court without some evidence of some sort. Is this in small claims court or something, because, you can talk to the judge and you can talk to child protective services to show there is no basis for the allegations. I don't think she will get anywhere unless your son cooberates her story.

Unfortunately, if you are correct, she will get further than she should in most cases. Typically, if child protective services are going to err, they err on the side of cautious for the child. (except in the cases where danger is eminent and they do nothing because they move slower than honey in a cooler)
I would simply tell whoever investigates that you and your son and your father are willing to take a lie detector test, or whatever it takes to quickly show your father to be innocent (and I truly pray that he is) as quickly as possible so his reputation is not permanently destroyed.
