Hey ya'll! i am currently 15 years old, will be 16 in june of 2008. I want to get emancipated this summer, but I am not quite sure of everything I will need to do, and I don't want my parents to know about this until it is official, so I can't ask them for help. Will they still let me be emancipated if I'm not in an abusive home? I just simply do not like my parents at ALL, and they are way to strict and refuse to let me see my boyfriend. But who do i go to, to get emancipated and like what do i tell them. will i need a lawyer, and will it cost a FORTUNE?? Because my parents wouldn't help me in any way with that. And also, I live in north carolina, will they rent apartments to a 16 year old? Me and my friend are going to rent one. Ya'lls answers would be greatly appreciated, thank you soo much!!!

I too am in NC and can tell you that in order to be emancipated you have to prove that you are in an abusive situation at home, or are otherwise in danger and it is unsafe for you to stay at home. Not being able to see your boyfriend (who your parents probably have a good reason for keeping you away from) is no where near a good enough reason. They will not even allow you to fill out the paperwork. Secondly, since your parents have to go to court with you, they will have to be involved from step one (they have to sign the application). Also, no you cannot rent an apartment at 16. In some cases, you can if you are emancipated BUT you still have to qualify for it. In order to qualify you have to have a sufficient credit history (which takes at least one year after you can get credit (18) and then you also have to be able to proove that you earn at least three times (sometimes four) the amount of the rent. Since the cheapest apartment you'll be able find in NC is about $500.00 (in a very horrible part of town) you'll need to make atleast$1,500 per month, not to mention enough for renters insurance, (approx $50 per month for someone your age/risk level) car insuranceclose to $2,000 per year for someone your age/risk level (for full coverage) which will be required for an emancipated youth under 18, plus other such expenses as gas, health insurance, car payments if applicable, vehicle and residence maintenance, plus bills like power ($50-100 depending per month) water (approx. $40 per month) cable and internet if you want it will be at least $100 per month. In short, if you don't make at least $30,000 per year then you don't stand a flipping chance. Feel free to verify that with as many adults as you wish.

In so much states, to get emancipated you must be 16. You additionally ought to have a role and a situation to reside, and a few cash stored. Usually you fill out a variety and ship it in to the state, who will deliver you a listening to with a pass judgement on who will come to a decision if emancipation is the fine alternative. Having your guardian's consent is helping, however you'll be able to get emancipated with out it. Hope this is helping.

You will need to prove:
1. You are mature enough to manage your own affairs. This is demonstrated by things like a clean criminal record, good grades etc.
2. You can support yourself financially. You will need to show income and anticipated expenses.
3. That your welfare is better served by not being with your parents. Hating mom's rules will not meet this criteria.
4. That there are no other reasonable solutions to the issues at home.

You will need to hire a lawyer to get you though the process.

You would need to file in a court that has jurisdiction over your parents or custodial parent if you do not live with both.

It's very difficult to get emancipated these days unless you are a child prodigy or something. The easiest way is to join the military. You would also need to hire a good lawyer.

It depends on state laws but check this out and make sure you are making the right choice - once you become emacipated you are entirely on your own financially and parents are not obligated to offer anything such as medical insurance, housing, etc. It may be best to wait it out!
