My father recently became seriously ill from our apartment complex negilgence. The complex sprayed chemicals and painted the downstairs apartment below my father's apartment. They did not fumigate or open any windows after doing this. As a result, these fumes came through our ventilation late at night and sickened my father. He is a heart patient with chronic lung disease. This aggraveted his condition and has put him in the hospital. Do we have a case against this complex and what kind of attorney handles these matters?

Before starting legal proceedings you should give the other party an opportunity to make it right. Contact them in writing and explain the situation that occurred and the cost that have been associated with the incident. If what you ask for is reasonable for the situation they may be willing to settle. give them a reasonable time to settle so they can not drag on. If they are unwilling to settle you would need to find a lawyer that specializes in liability cases.

THis is occuring more and more with non professionals using chemicals and sickening people around them. The more chemicals we are exposed to the more sensitive we become to them. We are all at risk with this sort of behavior.My guess is that you should have a case and if you don't you should change things to make it so. Toxic chemicals affect everyone. Some short term like your father and some long term. Personal injury, landlord tenant law, I would ask around and see. You may need more than one lawyer.

nope not at all ever i live in aprtment in they did the same thing in they told me if i did not like it move you will have to put up with managers like this all over the usa they only care about getting rent money thats it number one the ventilation are not all together in apartments they are seperation in each apartment if this was true then ever body in your apartment would have been sick from the fume to be sick so sorry but you do not have a case move out in get a house thats all i can tell you right now

Personal Injury.
I believe so,at least partially.The other part would be the Painter, for not ventalating the painted room(s). Most Lawyers will listen to what you have to say for free.So you can find out if you "have a case." Most charge a percentage of any "monetary judgement/settlement" they win you. I have no idea what it costs if you don't win.

You might have if they didn't notify you about the spraying beforehand. A lawyer that handles lawsuits is what you need. You may be able to find one who won't charge for a consultation to find out. Also be sure you can substantiate everything on paper. If you do sue them you will probably have to end up moving out, so be aware of that.

Read your lease and see if there is a release from liability clause. and before you retain a lawyer remember you have burden of proof. so can you prove that it was due to neglect or some other avenue the apartment complex is liable for his health.

you really don't have a case because they would tell you to open your window or leave the apartment if the smell was gettting to you. Sounds like a cheap attempt for a payday to me.

sue, sue, sue everybody! cash in. Tell me, is/was your father a smoker? have you sued the tobacco companies yet?
