He can most likely confiscate the phone per school policy if phones are not allowed on campus, but the minute he starts using your phone at all, it's no different than if someone else stole it and began using it. If your friends will vouch for you about this - and make sure they save the texts in their phones as proof- you need to tell your parents and contact the police and possibly an attorney.
Where I live, when a school confiscates a kid's phone, it stays under lock and key, either till a parent signs for it or until the end of the school year, depending on the school.
If he is really doing this, experience aside, he does not have the character or maturity for the job he has.

I see no problem with a principal taking a phone from a student. Using the phone without permission IMO would be theft . But I am not a lawyer, I am a statistician and UNIX /LINUX administrator Damn It.

That is tricky in a school context. Maybe maybe not to each of the questions, all independent of each other.
You would really need to talk to an attorney about this.
If the matter is important as public policy, as oppsed to a schoolyard spat, then you might try contacting ACLU or potentially EFF for advice.

If he's texting other people with your phone then it seems that he's impersonating you. You can probably sue him in civil court.
It costs about $50 to talk to a lawyer for a short time, and some lawyers will take on work like this pro-bono, which means "free".

I think a trip to the police and school board documenting his actions is in order. He may based on school policy have the right to take the phone, but he has no right to search nor use your phone.

Do you want him doing this....if not, I am sure you can do something about it. Talk to your parents about it and if that doesn't seem to work seriously call a lawyer or something.
