Your internet service provider issues you an ip address when you log onto the internet. your isp records who the address is issued to and thats how mpaa etc get you.

They have to catch you in the act of uploading the material back to the web to take you to court, It is not illegal to have the tracker file on your pc or to browse through the torrent sites. Torrentspy were told by a court to log the ip address of users to their web site and their activities - they complied for a short while (i believe) then quickly decided to stop all trafic from the US.

Peerguardian is a firewall which checks the ip address of all connections in the swarm attempting to connect to your computer against a banned list updated often. This is not fool proof as someone needs to get caught for the list to get updated. (the banned list contains all the ip addresses of the companies trying to catch you ip address).

Even if they did catch you they can not take all the people to court because it would cost them far too much and take forever - therefore they hang the large users up and make an example of the to scare the swarm into thinking they have it all covered. There are millions of downloaders on lots of sites and isps who continually offer faster speeds and unlimited downloads - (they are looking after themselves)

Most companies are now thinging of distributing their online film content via torrent to save bandwidth - full circle

They "rig" (for lack of a better word) the file such that your IP is reported, traced, and identified if you open/download the file. Pirating is not so smart with multiple major companies cracking down on it now. From a legal standpoint.
