We've lived together for 12 years, have 2 kids, are NOT married. MY parents own the house. Life is absolutely miserable and has been for many years with him. I really want him to move out now, but he won't leave. What do I need to do "legally" to get him out?

Sorry, I forgot to add one important detail. He doesn't have a good job and is paying a huge amount of child support to his first child. He doesn't make enough to live on his own and doesn't have very good credit either. This makes the situation that much harder. Please help!

call your local police station...tell them what's going on..have them at your house when he comes home...after he leaves change the locks and dont return his phone calls...if he keeps coming back get a restraining order...lifes too short to be miserable...believe me ive been through this same situation...good luck!

Your parents need to say you all have to move or say they are selling the home. Go find a place with him. Make him think your all moving. I would pack up and move your things out. After 1 month move back to your parents and change the locks. He now legally has a new residence. Bills in his name and a lease.

Sounds underhanded and allot of work with the moving and packing but I can assure you it is cheaper then a lawyer and
will take less stress as the courts will give you the run around.

Be sure that this is what you want, first. Change the locks after he leaves for work and don't unlock the door when he comes "home". If he tries to break in, call the police and have him arrested. Once that's done, don't back down. Follow through. You may have to get a restraining order against him, too. You also need to go to court to have suppoort payments set up, and visitation rights determined.

The other guy that says to move out and back in is onto something. I once had a roommate that eventually quit paying rent and was hideous to live with. So I was packing my boxes to move out one day and he came home and asked what was going on and I mentioned that I was moving out and he'd have to find another place to live. That was it. Worked great. I moved to a different place though and not back in.

Perhaps consult an attorney to see what course of action to take. I suppose "he" is content having a place to live, and does not want to make the effort to move out?

I'm sorry you are going through this. It has to be very difficult for you.

Go and see a lawyer for advice. It will cost you some money, but the lawyer should have the information you need to move this person out.

Since your parents own the home, as long as your live-in doesn't have a lease, they can have him evicted via a simple call to the police. It's their property, so it is their legal right to decide who is allowed to live there -- again, unless he signed a lease with them.

Contact an attorney. State laws are different.
In NC you have to Request an eviction have it filed and served then he has 45 days to pack up and go.

that reminds me of my ex boyfriend. broke, no money, divorced twice, pays child support and is miserable - i don't care. if i were you, call the cops or take him to court. do not
support him any longer. he used you too much , enough is enough .

See a solicitor and get a court order. It is quite simple.
