share a 2 bedroom with a friend for one year ,he lost his job and ask me to either move out ,or planning to have his ex move in to pay the rent for him! and all 3 share the place! the tentants in the building do not like him so does the landlord,he made trouble and the land lord likes me! can i get the place on my own???,aks the lamdlord to have him leave,his lease is up in 4 month? can he ask me to move? what are my rights?? can she move in against my will or the landlords?? we need to know !

Read your lease and/or talk to the landlord.

Boy that's a lot of questions.
Anyway, first of all the landlord is obligated to the tenant or tenants that are on the current lease, and vice versa, to meet the length of time stipulated on the lease. That lease can be terminated by the agreement of the parties only (both the landlord and the tenant/s) A new lease would have to be then executed between the landlord and the new tenant.
The current tenant could have a room mate if allowed on the original lease agreement under the clause for subleasing and or the number of occupants allowed. If the lease is silent to subleasing the new tenant/roomate would become the tenant on a month to month tenancy of the original tenant that signed the lease with the landlord but the landlord would have to look to the tenant who signed the lease if a problem arose and not to the roommate who is the the tenant of the tenant. The roommates could and should sign roommate agreements/contracts that stipulates the conditions and terms of their living together accomodations.

The landlord has the last say on who moves into a place. If you want him out, talk to the landlord and ask about taking over the lease in your name. You can buy your roommates deposit out by giving him the money he has in it.

whos names are on the lease?? that is the real question. if only his name is on the lease, he has a right as the sole lease holder to ask you to vacate the apartment in 30 days as long as the landlord approves of the new roommate. if both names are on the lease both of you would have to agree to terminate your side of the lease or vice versa. its really based on whos name is ont he lease to determine who has more rights.

It really depends on who's name is on the lease. If you have someone that you don't like living with, I'd just get out. If you get into a big deal fight with them, you'll both lose. Sounds like this is a great time to find another place.

Unless you have an agreement in writing, you don't have ANY rights.

She can move in against your will, but not the landlords. He doesn't have to let anyone live there he doesn't want there.
