We recently moved here from Ohio. One of the kids said that the drug dogs went through the school today and they found some marijuana in an unclaimed locker--I have no problems with the drug dogs going through and such.

He then proceeded to tell me that all of the 8th graders were made to take a drug test. Not sure what kind--he said breath, but maybe he meant saliva test. I have a problem with that, being forced to take a drug test without parental consent. I don't remember reading or signing any papers allowing the school to do drug tests. His grade he said, 7th, might be taking the tests tomorrow.

I was wondering if it was legal in California for the schools to have mandatory drug testing of their students--if it varies by school--etc.

Any info would be appreciated!

From what I understand, drug tests cannot be given to all students, for the same reason police can't search every house in a neighborhood without a warrant. Drug tests can be given to children with behavior suggesting drug use, and to children in extracurricular activities like sports or marching band. This is not just in CA, this comes from supreme court rulings.

I would advise your son to refuse the drug test, and contact the ACLU if they try to test him. My hope is that this is a rumor and that there are no mandatory drug tests for all students.

in California they took 5th graders to attend a gay couples wedding , calling it a field trip , that's how they are teaching our kids about homosexuality with or without parents permission and then they tell the children the ins and outs of that union whether the parents agree or disagree with it . The Mayor performed the ceremony in the Court House and behold the kids were field tripped right into the Court house where it was taking place , under the guise of just happened in if any law suits or anything arose by it . They even gave the kids rice to throw so they could participate in it as well . That's the gay agenda , its show children and try and make it ''Normal" and desensitize them with the whole its 'Natural' and they are 'Born' that way Lie . Worse part is parents are allowing it to happen afraid if they protest their child will be outcast and or targeted by the school system...That's How............ And in Germany they have jailed homeschoolers and taken their kids by force and the law to force the parents to send them to public schools where homosexuality and inmorality and sexual teachings are done openly and knowingly part of the schools curriculum . You can either stay and attend public school and or else you can go to jail and have your kids taken from you if you refuse , or else you can move . That will be California's and Homosexuals next agenda and it has already started there with the trying to outlaw homeschooling in California Doesnt anyone ever read the news and or watch unbais News reporting ?

They can't just test every kid without probable cause. The cost of the testing alone would ruin the school board's budget.

There are exceptions for student athletes. However, the parents have to sign the release form that allows the student to compete and to be tested for drug use.

All students may be tested for other things as a matter of public health and safety. Head lice and pink eye are a common reason why students in a class are all checked. However, drug testing is normally only done on a case-by-case basis.

I would not allow my child to take a drug test.

My brother is a school teacher in california and he does not allow this.

One of the reasons is there are false positives on tests and your childs reputation would be ruined forever.

Home schooling is the only way to go now..I wouldn't send my child to any school in California...It is to dangerous.

They give kids ritialin and that is nothing but speed.

There is a Beta course you can give your child and you are better off and so is the child. there are to many bullies at school that pick on good kids. Plus all of the other stuff that goes on that you don't know about..

No teaching of reading writing and arithmatic...
Keep your most precious possessions at home where they are safe...and loved

In don't think they can force any child without parental permission into a drug test! Nothing like compelling someone giving evidence against themselves!

I don't think such a law would be constitutional!

Don't think it is, and you can only get arrested for possession or dealing, not smelling like it or breathing it.
