Hi she is 17 and he is 20. Her mother does drugs and has 5 kids 3 of which she pawns off on everyone else and she doesn't have custody of them either (proven unfit mother). The father lives half out of state and refuses to pay child support. They live with her mother at the moment. The girls mother smokes and blowes it right in her daughters face and there is always a fight going on in the house of some kind. Is there anything they can do to get away from this mess. They both would not like to raise a child in this enviroment. They would like to get married but she doesn't turn 18 until after the child is born.

Depends on if you live in an emancipation state. Mine is not. This sounds like a case for child protection.

I have a sense that the mother could care less and I doubt if she would ever be picked up before 18. I don't think the 17 year old is in a very good situation with a 20 year-old and pregnant!

I guess this varies by state. In Oregon a teenager must show they are as responsible as a 21 yr. old adult, still in school with good grades, gainfully employed and never in trouble with the law before they can be emancipated.

A pregnant minor will become a ward of the court until she is 21 - 25 yrs. of age, or becomes married. She will be supervised by welfare workers to insure her child is receiving proper care. Her chances at emancipation are zero.

The 20 yr. old father is likely to spend some time in jail and will have to register as a sex offender for the rest of his life.

Being pregnant/having a child does not emancipate a minor in any state

Ohio does not allow a minor to petition the court for emancipation.

As you stated, marriage is not option without parental consent.

Her only option is to report it to social services. IF she’s removed from the home, she’ll be placed in the custody of the state. So, if they’re hoping she will be able to move out/in with her adult boyfriend (and you didn’t state that, but if….), it’s not going to happen.

I don't know where you live but here where I live a pregnant teenager is emancipated automatically.
