My husband purchased a strawberry shake from McDonald's, and as he was nearing the end of the drink, he removed the lid and straw and started drinking it right directly from the cup. Well, he got suprised when a hard plastic plug about 1 1/2" long slid into his mouth, and he nearly choked on it. We called McDonald's about the problem, and they basically called us liars, and asked us to bring it back in. We took it directly back, and they started LAUGHING and said "oh, that is just the plug to our shake machine"!!!! LAUGHING people, I just can't believe this! Then they asked us if we wanted them to give us another shake. We said is that all you can do for us, and they said yes. I called the district office, and she said all she could do is send us a letter of apology and some gift certificates. When it arrived in the mail it was only 5 dollars in certificates. I think they really screwed up here and handled it poorly, what if a small child had gotten ahold of this? What should we do?

Be glad he didn't actually choke. Cuz, that would definately warrant a lawsuit, no matter what the reaction of the McDonald's corporation or employers was. But, yeah, I do not like that they laughed in your face and took it lightly. They are trying to make little of a big problem, only to avoid a lawsuit, which is childish, at best. They should have basically reacted by bowing and kissing your feet, aware that they could have caused a major trauma and /or death. I personally wouldn't sue, since your husband didn't actually choke. But, it's your decision, because I wasn't there, and I'm not the victim. By the way, I hope you still have this machine plug??? Because if you don't, there is no lawsuit.

You're looking for a law suit...that's fairly obvious from the tenor of your question and description. I can't say as I blame you since all the front line people didn't do much more than laugh...totally missing the point of the entire episode. Their offices are no better but you did accept their offer of gift certificates. Now that you've only received $5.00 dollars you're as angry as a panther stuck in a tree!
Here's the thing...no one was hurt and you can't sue for "almost" choking and a small child didn't get hold of it! You cannot sue them and you shouldn't. What you should do is take your complaint, if you have the time and energy, to take this up the ladder and all the way up to the CEO of McDonald's just to get your point across and perhaps get them to shore up their franchises. You can't sue them for handling it poorly since you, in the end, were also a party to that when you accepted those certificates. Did you expect free shakes for life? I do understand your dilemma here, however, I am hesitant to tell anyone to sue in today's litigious society. A society in which, an idiot woman sued them and won because their coffee was hot!

O my yes you can sue and believe me I would... That is when you can say that they are just not paying any attentiont to putting the equipment back together. I have worked at mcdonald's before and I know for sure that the parts do not what so ever come back off until removed! I would make sure you keep the piece you found remember the location the time and if you have the reciept keep that as well! I would make sure that you get you a lawyer right away! I would tell them you want to file a counter suit against the company for indangerment to a customer and harrassament.. It would be hard to sue them for anything if the plug didn't really cause any actual injury or suffering, unless you want to argue that the plug caused such emotional distress that you can never enjoy another shake again, and therefore they should pay you. But that's pretty far-fetched. Bad publicity can hurt them a lot more though, if you can find a way to make this incident public in the local paper or local TV news or something. That will teach them to laugh at their customers after dropping foreign objects into their shakes.

About a year ago, a co-worker and myself had a bad experience with coffee from McDonald's. After consuming most of the cup, the texture of the coffee changed. It was thick and downright disgusting. Within an hour of dumping it, we both began to feel sick. After calling to advise the manager, that there was possibly a problem...we were blown off. "No one else, had complained". I wouldn't bother trying to sue. It would most likely be a waste of your valuable time and court cost fees. Take the lousy five bucks, and cash it in at another location. Luckily your husband wasn't harmed. Best Wishes !

Dont sue you will lose and it will be a waste of your money and theirs. you will lose because
1. you accepted a the gift cards
2. NO ONE WAS HURT
3. the shake was ment to be drunk with a straw, in which case, you wouldnt have found the plastic untill the shake was gone or never would have found it

I agree with others. McD's is such a large company it would be so hard to sue them especially since he wasn't injured. They have people just sitting around looking for ways to throw people's cases out. I know it's frustrating when people don't take you seriously but just don't go to that McD's anymore. Once I found a worm in my fruit n yogurt parfait and the lady acted like it was no big deal and offered me another one. I was almost finished eating it too and saw it in the spoonful I was about to put in my mouth. I just got my money back and was so grossed out I banned McD's for years!

did you keep the piece? if you did then you can sue them, if you didn't then it there word against yours. about them laughing at you it is not right. he is lucky he did not choke on it, if it was a child then omg it would have been disastrous.

It's unfortunate that it occurred and that you didn't get big macs for life, but just get over it. It didn't hurt you.
Talk to the manager and tell them about your concern for kids, etc.
