Ok...so a few days ago i signed my book up with Amazon.com (its not going to be out until beginning of Nov.) Then today, just to see if Amazon put my book up yet, i typed in my title. Amazingly...my title appeared but it wasnt my book that appeared. It was a totally different one! I did the same search just a few days ago and that title didnt appear. I did the search a few months ago and the title didnt appear either. Some guy wrote a skinny little 128 page book, named it the same as mine, and is charging exactly the same price as my 288 page book! Worst off, it says his book was released back in June. So when my book is on Amazon in a few days its going to look like I stole the name from him!! Obviously this is just a horrible coincidence but is this going to be a problem for me besides him "accidently" getting my orders? (I doubt i will get any of "his" orders because his book looks like one nobody would read except his friends and family)

Greed- Our books are totally different. his is some kind of self-help book and my is a work of fiction. Are you sure there is a name search and registration? I think thats only for businesses, not books. Also my ISBN's cost much less than 500. I think they were 325 or 375 for 10 numbers.

Pink and Myra- Thanks for the support. I guess I'm just so frustrated that after all that work and time i spent to make sure that nobody else had the exact name as my book, for that publisher to only NOW put his book up on amazon, 4 months after it was released shows so much laziness on his publishers part that when I go full force into my marketing, i know that one or two books will accidently go his way and i know his publisher is doing no marketing whatsoever so no chance that i will accidently get some of his orders :(

Join the club-- you'll be in good company! There are lots of authors who use the same titles. Last year two big name author books were slated to come out at the same time with the same title: The Book of the Dead. One was by Patricia Cornwell and one was by Douglas Preston. They decided to hold Cornwell's book until this year, but it still causes some confusion. Not as much as the title "Sweet Revenge"-- about 20 different books by that title, people ranging from Nora Roberts to Fern Michaels and a range in between-- but enough.

You can't copyright a title. If you could, you couldn't have used that anyway as there are several books with that title or "For the love of money" as a title: and some are novels. Cover art may help: if it's distinctive, that'll help some people determine which "Love of Money" is wanted. More importantly, have a good plot and good writing. Good luck promoting your book! (In fact, you could make a joke about having a book with the same title as another book; might help the potential readers to remember.)

There are currently two books out - both called "The Book Thief". One is a world war 2 novel about a child who steals books, and the other is a non-fiction book about a man who DID steal old and rare books.

I found the first on the shelves, but cannot find the second and that's the one I want.

Ok first you need to get in touch with the man that has the same name as your book and see what the problem is then ask him if he has gotten any of the wrong book orders if he has or has not have him tell who ever sent it that it was the wrong orders they are _____'s books and then he might send them to you the books if you ask and then the person who sent your books to him will know who to send the books to if you tell the person who has the same book name as you to tell the person who sent the books to him you address and phone #

If that person published before you -- you can be sued for copyright infringement.

The name search and registration is $80
The ISBN pack lot for a few books is $500
The printing is cheap too.

Thats why there are publishers to handle this type issue.

There's a lot of books with the same titles. At least you don't have the same last name. Then that would really get confusing.

Plenty of books have the same title. As long as they're two entirely different plots, there shouldn't be any confusion.

calm down- people will know when they look at the cover and the author which one is by you. also, yes, i know you may be annoyed, but its really not a big deal. and who cares if someone thinks you stole it from him? yours is probably better anyway! BTW, what is the title of your book? well maybe you dont want to say because its supposed to be a surprise or because it will reveal your identity or something but i was just wondering...

The important thing is that the IBN number will be different. There can be and there are many books that share a name so don't worry.
good luck and hope you have a bestseller
