if it's self defense, but you have to be in immediate danger.Like If someone breaks into your home and you shoot them when they're not armed or threatening you, you could still be charged with homocide; same as if someone hurt you or a loved one and you go after them and kill them. But if you're in a situation where there's no other option, where someone is about to rape you or has a gun to your head,or something,and you stab them with a kitchen knife in a desperate attempt to escape with your own life, then it's legal self-defense and won't be charged as a crime. It's still murder in a moral sense, but is excused in a legal sense when it's a last resort. Otherwise, it's considered more vigilante justice,taking the law into your own hands,and the legal system would rather that be left up to them. But in a situation when the legal system can't be there to protect you, you have to protect yourself.

Double Jepardy, you cannot be charged with the same murder twice, i.e you try to kill hubby but it goes wrong and you get off with it, if you kill him later....asta la vista baby
