I had an irate customer take my picture to send to the newspaper? Is there anything I can do to stop him? I was in the right in not giving him his pictures he was trying to copy that were COPYRIGHTED!!! He went balistic and took my picture.....

public place? your retail business operates in a public park?? Your store is private property, and most stores have legal enforceable policies of NO photography on the premises without specific permission.

A "private investigator" is an officer of the court, like a bounty hunter, and is given lattitude in collecting evidence for trial that is not permissible otherwise. A court is not limited by copyright when it comes to evidence. An irate citizen has no special right to perform illegal photography, but say you punched him during this confrontation, the photo could be used at the trial.

Your customer is irate, but i doubt the newspaper will print the photo without your consent, given the circumstanses. They might carry the story so you should be able to explain why photo stores are not allowed to reproduce copyrighted materials. Having that printed may prevent future episodes like this.

He can put the photo in his personal scrapbook, and show it informally to friends, that is about the extent of its distribution.

You need to consult your employer as the the policy regarding the retention of pictures that are in violation of copyright laws.

If he does send your picture to the newspaper, he will likely not get it published without telling where it was taken and who it is of. The paper will check with you to make sure they do not print a false story that could get them sued. You need to know if your company will allow you to give the fact to the paper. Namely that the customer was breaking the law and got irate when he was caught at it. The story could backfire on the customer if the paper has any sence of justice.

I don't live there but I am pretty sure that it is not legal for the paper to publish it without your consent. I am not sure about the rest though," him snapping a pic of you", I would contact the police to see what you can do to get your picture from this guy.

No, I used to be a special investigator registered and licensed in Ohio, West Virginia and Kentucky and there is no such law. I made my living by taking pictures of people covertly and catching them in different illegal acts.

If you are in a public place, you have no expected right to privacy. So you can have your picture taken and published without consent.

This is how the paparazzi operate.
