i would send a confidential note to Human Resources. unless the bathroom indicates that both men and women can use it, he should drop off the kids in the boys room. bathrooms are designated for a reason and he needs to respect that and if he's uninformed, he needs to get the low-down.

Overpass bathroom in Chicago, women's line was around the corner and down the hall, men's room had no line. Women were going into the men's room and using the stalls. When you gotta go, you gotta go.

Careful. In many states questioning a person's gender identity can be considered harrasment which can lead to firing and being sued. Blame liberals for that.
I think the lawsuits are crazy, by the way.

is it the type of restroom that is one room that you can lock, where do you work, it is weird if there is more than one toilet, but at my work I use the womens restroom because it is a one room restroom and it is closer.

You should tell someone and make him stop because i don't think its illegal per say but it's not work appropriate . He's probably a Perv who is trying to look at you woman. But make sure it really is a guy first.. you never know.
