Who you live with has NOTHING to do with disability payments. Your ability to collect depends on what the disability is.

If you have a disability that prevents you from working you can apply for Social Security Disability. This is a federal issue and has nothing to do with;
The State
How much your partner/spouse makes
Being 40
This is all assuming that you have worked in the past and have contributed to Social Security.

first you have to have a doc. state that you have a disability and how much of on that you have and then you have to jump threw a bunch of hoops for the state and then go from there but i know of people who have fought for their disability for years so good luck
