I'm going to try to keep this simple. I'm not looking for any legal advice at all, I just want some opinions on this situation.

My husband started working for a trucking company. A few days into the job, he slightly damaged a truck. He told the owner about it immediately, he offered to pay for it. The owner said - no worries, you aren't used to this size truck, you don't have to pay. The owner ended up firing him 5 or 6 days later due to a conflict they had. We have now received, with husband's final paycheck, an invoice addressed to my husband for $2600 to pay for damage to the truck. When my husband was fired, he had to write up an explanation as to what happened and sign it. He even included the fact that the owner did not want him to pay for it when it happened.

Can we call the insurance company to see if he placed a claim? I personally think he is trying to get double money which would be insurance fraud. Can they do anything legally to get the $$ from us?

An employee can not be charged for equipment that is damaged in the performance of his duties.

What their doing is insurance fraud trust me. I was in almost the same situation. Did you get any legal documents for your husband to sign? If not then you guys don't have to pay for a thing. As long as you didn't get any documents and your husband didn't sign them saying that he was going to pay then your fine. I would check and make sure that they didn't file a claim and with your husband being fired that's just a little fishy not on your part but theirs. Which means that they realized that they could get more money out of you guys and had to get your husband out of the picture. But yeah what they are doing is 100% insurance fraud.

If the employer has insurance, that insurance should cover all damages except a deductible. I am not sure if an insurance company can tell you whether someone has or has not made a claim as this may violate that person's privacy rights. At most, your husband should be responsible for the insurance deductible and nothing more.

I think you should call your Attorney General and file a complaint. It sounds like retaliation of some kind. Maybe the insurance company wouldn't pay so they want your husband to pay. You should also check at your state capitol for the employment department. They have the rules that will apply. Good luck.

I drive Truck parttime and know the problems you can run into since he got fired I wouldn't pay
