I have spent over 10K attempting to sue my neighbors! Our judge has had oposing council in his chambers prior to our hearing. We have been at court 4 times and the judge still wont issue a TRO even with testimony from the defendant that he has written horrible stuff about me, gone to all my neighbors and slandered me, and is actively trying to get my husband fired from his job as a police officer. I am at my wits end and about to have to start selling off property to continue with the lawsuit and we have not even got to trial yet. This neighbor continues with his harassment and hateful behavior and I feel like there is no justice for my family. How do you stop a bully when the judge is obviously going to side with the defendents regardless of what evidence I have and believe me we have tons of evidence!

While you MAY have "tons of evidence" you did not show any here.

You are not trying to "get a simple restraining order against my neighbor", you are try to get a TRO and to sue your neighbor.

TROs are not normally granted because someone writes horrible stuff about you.

There is a LOT of stuff you are not telling us. You have been to court 4 times and that is expensive. Your lawyer has accomplished nothing.

If the judge sides with the defendant, there is generally little you can do -- and for an issue like this, unless you can actually show collusion with the judge -- it's very hard to win an appeal where so much is within the discretionary authority of the judge.

But obviously -- from four hearings -- it's not a simple TRO -- the TRO is just meant to get you from the initial filing until the first hearing -- and asking for a longer restraining order requires you to prove that you are likely to prevail on the ultimate merits of your case -- and a defamation case could easily run $50K to $100K before you are done.

What have you spent this $10,000 on? Do you have a lawyer? If you do and the court allowed an "ex parte communication" with the other side that did not include your lawyer or you, what does your lawyer say about that? If nothing, maybe you need a different lawyer.

If you do not have a lawyer, why don't you? Is it because no one will take your case? Is your "evidence" admissible?

There's more to this story than you present.

Temporary Restraining order does not mean sh*t if you get one , It would have been lots less money had you just knocked the sh*t out of the neighbor , a couple hundred dollars , and a misdemeanor charge which is nothing ...I have 9 of them from knocking people out , my fines are up to the 600 dollar range , but it is not too bad , it is worth every dime , I tried to pay in advance or just run me a tab , but they would not do that for me ...The judge told me it was pay as you go ....Just kick the neighbors @ss ,and be done with it ..

Move out of your trailer and get a new place to live with no neighbors. Your wasting money, time, and effort.
