My ex girlfriend and I broke up recently. We were living together and when she left my place, she took all the appliances we bought. The fridge, washer and dryer, plasma tv, you name it, all was gone. So I took my car back from her. I took out a restraining order on her and she retaliated by doing the same. However, in her order, she put down that I stole her car and wants it back. I bought the car back in april with a money order that she provided me. She has the receipt of that money order. However, I registered the car and it's on my name. The reason she gave me the MO is because I put the money in her account. She also retained an attorney. Can the judge make me give her the car back even though it's my car in my name? She plans on saying that I stole her title, keys, and car. Meanwhile, I always had the title and the keys. I didn't steal it. Should I get an attorney? Can she sue me for a car as part of a restraining order or does it have to be a separate civil matter?

Some important questions:
1. How long did you live together? In some states, if you have been living together for a number of years, you are considered common-law married, and she has a legal right to half your stuff.
2. Were the appliances, tv, etc., purchased in your name, her name, or jointly? Do you have documentation to that effect?
3. If the car is in your name, and she isn't on the title, she can't do anything to you, as the car was never hers. If she takes you to court, you can subpoena her bank records and get a record of the deposit of the money order to prove you paid her the money.
It does sound like she plans on getting nasty. You may want to also retain counsel.

The car cannot be part of the restraining order. She will have to sue separately for that and it will cost her.
You should discuss this with an attorney and get him up to speed on the situation so that if she does sue he will be ready to move forward. With the car title in your name I doubt there is anything she can do.
What about all the appliances she took? Who bought them - who has receipts. Can she be accused of robbing your apartment - might be something to threaten her with.
Then, when this is over, stay away from this crazy woman. You deserve better

well i really don't know but in my opinion they might order the car to her because you put the money in her account but she took it out and purchased a money order so she has proof that the money was in her account and that you just registered the car in your name, but then they can look at it and say that it's your car because it's titled in your name and registered also. but i'm just sayig my opinion i really don't know.

This is why you don't live with someone you aren't married to.
If you have receipts showing that you paid for something she took, you can file a claim in court against her. Otherwise, you are probably in trouble.

You need to have proof that you put the money in her account, otherwise it's he said, she said. As long as you have a paper trail, the thruth will be found.
Without the paper trail, the judge has questions.

Geez. Quite a lot of BS for a breakup, isn't it? Title is title. If it's in your name, it's yours. She's trying to scare you, hon. Unless she can prove you stole it, she's got nothing. It's your word against hers.
