Illegal? Depends on what you do with it now that you have it. Sell it to the news, and you have invaded someones privacy. Put it on your blog, perhaps the same thing. Erase it, no harm. Keep it but only look at it yourself, no problem. Unless the school has a rule in effect about classroom activities and privacy. Then their rules would apply.

Classrooms fall into a weird in between of a public place (where such recording would be legal) and a private place (such as a restroom where such recording would be illegal). The school board, city, country and state has the right to pass rules or laws that prohibit video taping.

If she had an expectation of privacy, then yes. If she was in a public place, then no. Now if you tried to record up her dress or something like that, then YES it is illegal.

If someone is over 18 it is not illegal however, if they are and you plan to use the footage it requires consent of guardian.

i'd be more concerned about the school taking me to court----its their responsibility to provide a safe secure environment for all its students-----filming people in class w/o their permission could result in your expulsion
