If the state law says sex with a minor is statutory rape with no comment about ages of those engaging in sex then it is rape.

The states that put an age range on it did so to cover "young love." I believe a common age spread allowed is 3 years.
IE: An 18 year old boy can have sex with his 15 year old girl friend but if a 30 year old guy tried it, it is rape.

You need to check how the statutory rape laws read in your state. If the girl is jail bait, then she is jail bait. (Or boy, statutory rape works both directions.)

"Going out" doesn't mean anything. Yes, the 18 year old can go to jail and be listed as a sex offender if he is turned in to the authorities. How the minor feels about the adult doesn't matter either.

Unless the parents are very strict and vengeful, nothing will likely happen without a complaint being filed with the police.

Love has nothing to do with it -- and prior social relationships have nothing to do with it -- not even 'consent' by the minor has anything to do with it -- that's why it's called "statutory" rape.

The issue is what the rules are for age of consent in your state or country -- and in some, a minor of 16 can give consent and it counts -- also, in some jurisdictions, the relative ages matter -- so if they are within 2 years of each other (for example) that is often an exception.

Laws vary by jurisdiction -- and in this case the details of the applicable laws regarding age are absolutely crucial to determine whether that law was broken.

How old was the minor?

In some states if the minor is 16 and consulting it could be different then other states. ..

You need to ask a lawyer in your state.

Call a lawyer that pratices criminal law for sexual offenders.

Sometimes they will give you an answer over the telephone...
