I thought I had paid first and last months rent, but it turns out that I paid first and a deposit. I was given a 3-day notice, by my apts, I went to go talk to them about the notice. I was told that I took to long to meet with them and I was going to be served a notice of lawsuit to evict me. All I want to do is pay what I owe so I can move, without going to court. I just am not sure what I am suppose to do, to resolve this issue.

Without seeing your lease you should be OK. Pay them the money you owe and give tehm their 30 day notice. They will be happy to skip the eviction too, it is not cheap. You need to avoid it if you can, it attaches to your credit report.

If you waited past the expiration of the 3-day notice they are free to proceed with the eviction. If that's what the landlord wants to do he cannot accept your rent now as that would kill the eviction process. In some states you may be allowed to pay the rent due as part of the eviction and quash the action that way. Consult with a local real estate attorney to see if you have any rights to stop the eviction by paying the amounts due.

You would have to look up your state's landlord tenant laws regarding evictions.

Some states allow a landlord to accept payment but continue with the eviction. Some allow the landlord to refuse payment and continue with the eviction. Others do not allow the landlord to refuse payment and if paid, the landlord canot evict.

I would try to talk to them again. If that does not work, you have to go to court. In court have all of your money ready. You will have to pay the court costs also for the apt complex. It sucks, but you will know next time.
