Yes. It's tantamount to a threat. A noose can be considered an instrument for murder as is clearly being signified in this act. It's like saying, with no stretch of imagination, 'We're going to hang you just like our ancestors hung your ancestors." It is as offensive as burning a cross on someone's front yard. What's next? People running around under white sheets with torches and pickaxes?

Hanging a noose itself is NOT a hate crime. Beating the hell out of someone due to the color of their skin, sexual perferance or religion is a "hate crime". Frankly I think people are way to thinskinned and need to stop trying to find a damn reason to ***** whine and complain. I have a ghost in my front yard hanging from a noose should all the white ppl be offended? Better yet I think a "black student" should walk into the "hangout"(if your not making it up ive not read nothing about this) to show that they are not frightened by this thing hanging. Furthermore what business owner would allow such a thing on their property.
Wasnt long ago my best friend (a black woman) applied to the KKK. Told them if they turned her down she'd sue for discrimination!

People misunderstand hate crimes -- the "hate crime" is not a crime by itself -- it is a sentence enhancement to some OTHER crime based on the underlying action and the different mental state.
So, is there a federal crime prohibiting harassment -- I don't know, I'd have to check. But if there is -- and if there is a sentence enhancement based on the intent to target a particular race -- then the prosecution could bring the underlying harassment charge, and then tack on the sentence enhancement of the hate crime if they can prove those additional facts.
But there first must be an appropriate underlying crime -- and at the federal level, other than Civil Rights laws and harassment based on racial issues under the 13th Amendment -- it would be very difficult to find an underlyinjg federal crime that would apply.

America is a democracy and that is a beautiful thing. However, it is unfortunate when people ignorant of the law believe they know all the answers. Hanging a noose in a tree is not a specific law. However, it is at the discretion of the officers to see it as a hate crime, a threat or even just inciting violence. Considering the circumstances, it was indeed a criminal act. Unfortunately, it was not dealt with as such. Had it been dealt with as such, the numerous fights and the racial tensions at the school could have been avoided.

I think that would be a little silly- nooses weren't (aren't) reserved for any race in particular.
I realize that African Americans want to turn the noose into their very own symbol of martyrdom but alas that is just not historically correct.
Those familiar with history realize that hanging was the modus operandi of executions for centuries all over the globe and still is in some parts of the world today(Iran in particular).
Besides if some rope hanging in a tree causes your psyche that much grief, therapy would probably be more effective than legislation.

Absolutely! That makes me sick, and ashamed of my own race. There is no reason for that at all. That is just stirring up issues, and whoever is doing it knows that. It doesn't take a brain surgeon to figure out the meaning behind that whether people want to admit it or not.. Most likely they know what the outcome of what doing this is. It's easy to say that's not what it means, but if not what does it mean? It's Halloween soon, but really what else would that mean??

No, it should not be a hate crime. Sad, but true. It is protected expression. What I'd like to see is those idiots do it someplace where they didn't feel so free to be so offensive, i.e. go to a predominately black neighborhood and do it. See how tough you are then. It would still be protected, but if they feel so strongly about it, then be REALLY outspoken.

It's in horrible racist taste but it's not illegal. It's freedom of speech. People offend people all the time in this country. I've seen some pretty nasty stuff on here. But that doesn't give you the right to resort to violence and to take the law into your own hands, as they did.
