A female passenger is arrested for robbing a female bus operater, the passenger got on the bus and ask the operator, why she was so late getting to the bus stop, the operator got testy and became forceful and rude, when she took the passenger's bus pass and would not give it back it creating a situation for the passenger who then refuse to get off the bus with no pass or cash to get home. The passenger told the bus operator to give the bus pass back and the operator push the passenger in the face with an open palm and starts a phyicscal altercation with the female passenger who then hit the operater in the lip. The female passenger refused to leave the bus without her bus pass. So the bus driver push the female passenger in the face again and starts another round of fighting. And then the passenger took the operator's purse in return for her bus pass. The police was called and the passenger was arrest after five witnesses made statement in her behalf.

Several potential crimes or civil wrongs occurred -- the taking of the bus pass (which may or may not be authorized, depending on the terms of service on the pass) -- the initial assault and battery by the bus driver -- the assault and battery by the passenger -- the attempted theft by the passenger of the driver's property -- etc.

The procedures are simple -- the person arrested will be "booked" -- asked a serious of basic questions -- name, address, date of birth, etc. They may or may not be interrogated by the police -- if they are, the police should read the person Miranda warnings before any interrogation.

The person may or may not be released from custody immediately -- or they may be held over for a bail hearing. Either way, if the prosecutor decides to press charges, their will be an arraignment -- where the person is notified of the charges and asked to enter a plea. If the charges could include possible jail time -- the person will be asked if they need to have an attorney appointed.

After that, if the prosecution continues -- a lot more steps happen, including pre-trial hearings, plea bargaining, etc., -- but your attorney (if any) would handle explaining those.

As to rights -- you have the right to be notified before interrogation of two (other) of your rights -- your right to remain silent and refuse to answer questions -- and your right to have an attorney present during questioning -- you also have a separate right to an attorney for any trial-related matters -- and you always have the right to have your own attorney present, but you only get one appointed free if the sentence could possibly include any jail time.

As a side note -- while the return strike against the driver by the passenger may be (maybe!) justified since the driver struck the first blow -- the taking of the purse is almost certainly not justified under the law.

She will be arraigned in front of a judge, and at that time charges can be dropped or become official.

After that, it wil be up to her attorney to do the best job possible by mnakig sure the witnesses are credible and present at the trial.

I am not thinking the person here is a rocket scientist.

I am not finding it credible that the story happened to you quite like that, but that is what a jduge and jury are for.

Sounds like you may be scurting the details..... but maybe not.... I took my kids on a carribean cruise. I flew to pick them up from a relatlive they were visiting breifly, and scheduled a greyhound bus to go to florida to meet with my husband and continue our vacation together, they enjoyed the initial bus trip and learned alot. we met drivers and changed busses as well as, seeing what life was like for people who rode busses.... I'd witnessed this myself much as a youngster and was happy that although they were humbled by it they appreciated what they had...... After the family cruise the kids and I took a bus back to the relatives they were visiting ...... This time it wan't so great... I, as a former bus traveler, asked the driver of the bus we initially boarded (In Orlando) if we could open the roof vents " the lavratory had obviously not been emptied in a while and all the other passengers were "complaining" ( Some were cussing and yelling) I thought I could help the situation by simply asking the driver (who had been yelling back at the back and threatening the uprisers) if it was OK to open the roof vents, The mad driver immediately pulled over threatened to fight me (She was very graffic) and when I humbly appoligized and told her I was just trying to remedy the situtation, she became even angrier and more belittling, she threatened to have me arrested, and even stated that as a bus driver she could have me arrested and my white N---g--er kids would become prpoerty of the state "as she called it" given that I had children on the bus (I remained silent except for begging her forgiveness and asking her to let me get my kids off the bus) She refused to let me get my kids off and told me that she would let me back on the bus if I promissed to tell no-one of it).... I waited in silence until we reached Atlanta, GA "We changed busses there" I went to the customer service counter and asked how to file a complaint, I was given a form and wrote a lengthy complaint and asked witnesses who were also on the bus to fill out a form detailing what they had seen---(These witnesses were not people I knew or spoke to previously-They were simply on layover in Atlanta and I recognized them from the bus) They all filled out there own form, The customer service counter would not give me additional forms so each of the people had to go to the counter and ask for their own complaint form..... Most sought me out and showed me what they had written, It was heartbreaking, apparantly, this type of injustice happens regularly to many bus riders on greyhound... I would have never guessed it.... Things were different back when there was also a trailways line crossing the country.

I understand that you are referring to a city bus route, but, The details of injustice are similar. "We The People" have rights.... I think that bus drivers do deal with the poor more often than not, If dealing with the poor makes them feel they can treat anyone in this manner they should not only be fired but prosecuted.... Sorry, I got back to my busy life and aside from writing a letter in which I recieved no response from greyhound I did not take my matter further..... I think it's time someone did. I did notice that the abuse I suffered was from a Black Female Driver and I think it may have been racially motivated against myself and my children who are cuacasion. The kids had full head (blonde) braids from freeport (funny thing is the braids that cuased so much tension to the driver costs far more $$ than the bus ticket) and the woman did say "You and you white N---g-r kids got no right saying anything to me!" as she was threatening me.

Injustice must be fought, I realize as I age that back then, I did not take a stand, I was afraid that this injustice would be turned on me for being a different color than the driver, who was not only racist but seemed to be high. In my ignorance and belif of what this madd woman stated, I allowed my kids to see me cower, so they truely did learn what it's like to be a poor caucasion person.... I think it wrong to discreminate based on race...... I think it wrong to discriminate based on income level.... I think this mean spirited racist bus driver thought us to be poor white trash...... If white/black/yellow/green (any color) people are treated this way, by a mass transit system....My goodness, We have a problem......

If you think I'm not an experienced bus rider, you are wrong, I took my first cross country bus trip as a teen. and have taken many others, though I am afraid to now as a caucasion. I'm not afraid of the cities, or the passengers but (some) drivers.... That woman was crazy!

First, of all, the operator hit the girl, so that would be assault.
