on average a criminal one and how many hours for a simple pbj case will I spend with them. I just dont want to get ripped off.

Most criminal defense attorneys charge by the hour -- and anywhere from $50 to $200 is reasonable based on the experience of the attorney -- but very high-profile attorneys in complex cases can (and do) get much more than that.

Some attorneys charge a flat rate, based on an estimate of how long the case would last and how much work is required -- and for a misdemeanor, anywhere from $1000 to $5000 is not uncommon -- for a felony, of course, prices go up because a lot more work is usually involved.

Also, even for hourly rates, it's not uncommon for the attorney to ask for a certain amount up front -- usually in the $1000 to $2000 range, and then would bill for additional hours as they accrue.

How do you know it will be PBJ before the case?

Depending on the charges, expect a minimum of $1000, charged at anywhere from $50 to 500 per hour, and days in court are probably 4 hours minimum regardless of the time spent there.
