I want to look into getting a will for myself and my husband, but I am not sure how to go about doing it. Do you have to go to a lawyer and is it expensive?

There are sites where you can download papers to do your own will, but I wouldn't recommend it. Especially since there are children involved. See a lawyer. A will, done by a lawyer, will cost you around $400 to have done.

Please, please, please and please make sure you donnot die without a will. Gosh it can leave such a big mess. People who do leave wills still leave a big mess you know, especially when beneficiaries are dissatisfied. Don't be too quick to say you trust your in family members' unity, even your children. People are always full of surprises, especially when the is something to be gained. greed is a powerful motivating factor that can lay dormant for years. I sholud know and believe me, I do. I've been through stuff from my sister over our daddy's property. And he left a will!
Yes, you do need a lawyer, particularly to ensure that there are as few loopholes and loose ends as possible, to ensure the document is water tight in order to protect the ones you love. I'm sure you can find an affordable lawyer. It might help to talk to friends or older relatives to get a recommendation.
All the best.

Get a pro forma will off the internet and fill in the blanks.
Agree with your husband and have it witnessed.
That's all you really need to do.
Unless there is a lot assets it is usually not a problem.

The real need for a will comes down to what happens to the children in the event both of you are killed while the kids are at home.

You don't need a lawyer, you only need a certified will writer. Just look it up at the search engine or yellow pages.

Without any legal documentation, kids and belongings will go to your next of kin.

Assuming there is no will:

- If one parent dies, the children go to the surviving parent.

- If both parents die, children go to the legal God parent.

- If there is no legal God parent, the children go to an immediate family member.

- If there are no immediate members, the children become ward's of the state.
