As a point of law, a pharmacist can legally refuse to fill any prescription as long as the decision is not made on the basis of religion, race or national origin. There is a legal liability when the pharmacist fills any prescription including such instances as abuse of narcotics. The mere fact a doctor writes a prescription does not absolve a pharmacist of the responsibility should the doctor merely "sell" prescriptions to addicts or for street sale. In the case of forged prescriptions, I don't just say I don't have it but after verifying it is phoney, I call the police. I have thrown more then 100 people in jail over the years for forged prescriptions. I also have refused to fill prescriptions for customers who are rude to me or my help or use foul language to us.

Oh yes! I used to be a manager in a drug store. The pharmacist can most definately refuse.. for instance.. if the medication is a pain killer ( a narcotic) and the prescription is for one pill a day for thirty days... If the patient comes back within a week.. demanding a refill.. the pharmacist can deny it. its too early for a refill and the drug is really hard on the body because its a narcotic.
also the pharmacist must call the doctor to verify the drug if there are any questions.

If you have a legal prescription from a doctor there is no reason why a pharmacist should refuse to fill it, unless your name comes up as "red flagged." This means that you have been to other doctors and other pharmacy's and have had the same prescription filled and are getting double doses. Alot of prescription drug addicts do this. Eventually their name comes up in all the computers and they often get turned down. If you are not one of these people, then I would talk to the manager or go to another pharmacy.
