My mother-in-law is legally married but hasn't been with the guy (a career criminal) for many years. She is lazy about following through with the divorce so my husband and I want to help her file the paperwork finally. Any suggestions how to do this? She resides in Ca, we think he is in Tx. I believe they got married in Tx back in 1980.

A simple uncontested divorce at hand. let her file for divorce at her nearest county clerk court. If she remember the address where she used to live with her husband, that the address she would write down as a mean to contact him. The court will find him in public records and sent him the divorce papers which he will be give at least 60 or 90 days to respond/ sign those paper and mail back to california. If he don't sign at that given period or the can't be located. one signature is enough for a divorce degree

My ex wife went through something like this a few years before we got married. Guess I should have taken it as a sign, but there you go................

What she did was hire a lawyer who posted an announcement of intent to divorce in the paper where her ex was last known to live. She was in California, he was in Oregon or Washington. After a certain number of days... I think it was 7... they went back to court and filed that they had attempted to reach him, showed the proof of the announcement running, and the judge granted her a divorce in absentia. Basically its to give the other party a chance to respond if they so desire to respond. Look at the classified section of your newspaper... where people file for fictious business licenses... that's where you post your "We are divorcing unless you show up to say why we shouldn't" announcement.

I wouldn't try this on your own........... get a lawyer who knows all the laws of the county that your MIL lives in.

she has to do it. You can take her to the courthouse to fill out the paperwork, but she has to be the one to make the complaint. Abandonment would be grounds, but I think you'd have to advertise in the last known location.

It would be a REALLY REALLY GOOD idea to ask an attorney.

if they haven't been together in 15 years then she should be able to file quite easily on grounds of dissertion. you may have to take a newspaper ad out to publicly notify him but that s about it.

First hire a private investigator, then a lawyer.

if hes in jail she can get help with filing for practicaly nothing . find out threw human resorces
