I work for a company and I was hired as a driver. They don't have enough hours for me to drive so they also have me work in the shop to get my 40 hrs.

I've been told to keep track of my hours because they don't want me working overtime in the shop, if they have to they'll pay me overtime for the road but they don't want to pay it for shop work.

Well today I was scheduled to work a 13+ hour day on the road and leave at midnight. Prior to this I had asked if I could get off early on the day before so I can get some rest, they were ok with it.

Well yesterday I left after 6 hours to get home and get rest.

When I got back from my 13+ hours today I was asked not to leave early on the day before because they're busy in the shop and I'm told they want me to get as many hours in the shop.

I try to explain that I worked 13+ hours today. I'm going to have to take some time off some time in the week why not on monday?

He then just says don't take off the day before anymore.

By law there are limits to the number of hours a person can work. Even the ones who do odd shifts (like paramedics and emergency personnell who do 3 days on and 4 off) have limits. You might want to check with your state as to what is legal and what is not for your kind of schedule.

Just start driving 2 hours later, and take off the day after
