I posted something a week or so ago asking if anyone was an emancipated minor or knew anything in regards to becoming emancipated. Someone posted a response saying that it was easier to become an emancipated minor in montana- I did not have internet access for awhile so by the time I found the answer- I could not email that person----

if you have any information about it being easier to be emancipated in certain ways, or states-- or are the person who answered my question before- please respond.--thankyou

While that may or may not be true (that it is easier in MT), the MT court will not even consider the case unless you are a resident of the state.

To be emancipated by the court you will need to prove:
1. You are mature enough to manage your own affairs. This is demonstrated by things like a clean criminal record, good grades etc.
2. You can support yourself financially. You will need to show income and anticipated expenses.
3. That your welfare is better served by not being with your parents. Hating mom's rules will not meet this criteria.
4. That there are no other reasonable solutions to the issues at home.

You will need to hire a lawyer to get you though the process.

Unless you and your parents/guardians are legal residents of a state, you cannot get emancipated in that state. The court will dismiss your petition and ask you to refile in your parents' home state.

The easiest way to get emancipated is to join the military.
