My employer advised me since I'm in-active status due to me being on leave of absence (LOA) that I need to submit a letter advising that I'm resigning and excepting the serverance package, which does not make since to me, since they are giving me this option. I'm not sure what to do or if that is right.

If you are on an official LOA from your employer you are treated for all intent and purposes as a regular employee. If your employer is offering various severance packages to its employees it is obvious that the intent is for the employee to resign their position in lieu of receiving some benefit from their resignation (probably financial).

So, yes you would be required to relinquish your position if you accept their package and I would suggest that in your resignation letter that you are resigning your position specifically due to the severance package they are offering you at this time.

What is the nature of your LOA?

If they are laying you off while you are on your LOA, and giving you a severance package, then they would not need a letter of resignation

A letter of resignation looks like you quit which means you would not get unemployment

This is very odd - and I would question it

Why wouldn't you want to? It's better for both them and you if you have documentation.
