I live in Michigan. got served divorse papers today, can't afford an attorney and don't qualify for free advice. got married 10 years ago,had a child and due to myself being abused left after 3 years. We stayed married because he said he would on day inherit money and after 10 years that is a reality as his father has passed. Now I get served and he wants to, get his, have his child support lowered from $109 a month and my child doesn't get any of this inheritence. What do I do? I don't want his money but want my child support. He has hidden his money from the court and says there is none.

to Colleen who stated for me to get a job, I HAVE ONE! I didn't say I didn't work, I do. I just don't have the $1000 retainer the lawyers want.

How on earth can child support be only 109 dollars a month. i bay 6 times that amount? I am not complaining. I believe my child benefits from it and will be better off. I am amazed how men skirt there responsibilities at being a father and taking care of there children. I would say hire a forensic auditor. But you can not afford it. Try your states services bearue. See if they can help.

First of all, you can do it yourself or with the help of an independant paralegal. Second, answer the Petition for Divorce in the same format as it was received. Putting down the things you want and don't want. Apply for an application to waive the filing fees and send your soon to be ex a copy. Third, have someone prepare a Petition for Order to Show Cause for spousal and child support until the proceedings are over. There are too many things to tell you that need to be done. But for sure answer the petition for divorce immediately. You have a limited time (20 days) to do so.

An inheritance is easily located, because it is taxed. Since you are still married - the IRS can give you copies.

In your case, if you are being truthful, contact the N.O.W. They will give advice, but do not listen to revenge advice. It may not work. If you were faithful for all of ur marriage time, then they can give you a good lawyer. He will take his fee from the husband through the court, and u will gain, I am sorry he left you with child. I will ask a question that is not considered politically correct. Are you married to an American/African male? Pastors are warning about this... One man had 12 children that he did not support, and only two of these were of the same woman! Good lines but no support! One thing that needs to change in the black American communitee is the respect for women and the idea of commitment. We will not see this until we elect those who support responsibility 4 our own actions instead of those who want to pass the buck. We have that in the Democrat candidates... and they will continue to give fatherless children! God bless, Earl

as long as he has a job he has to pay and if he doesn't pay he will owe back child support. How he hid the money i am not sure but you may want to have a request for all accounts with his name on them because he may be on someone else account like a brother or put the money into another family members name look into it. It can't stay hidden forever he is going to use it at some point and when he does you just have to show where it came from

Unless you can PROVE that he has money then your allegations won't stand in court. YOU chose to remain married to this man in anticipation of him getting money however his inheritence is NOT considered income and therefore neither you nor your child are entitled to any part of that inheritance. YOU don't get child support that is for your CHILD and the court will determine how much you get based upon his INCOME, not INHERITENCE. I suggest you get a job to support yourself on.

You can have his financial records subpoenaed. You can check with the bar association- all lawyers have to do some pro bono work every year.

don't take advice from these people, get an attorney and figure out a way to make payments, or see if they are doing any pro-bono work
