I bought a quad from a person, long story short. He took the money, never paid off the loan. The bank owns the quad and is going to repo. the ATV.

Is there a legal way I can go about getting the account information and copy of information for proof that the account was never paid off? I have been in contact with the bank and they know who I am, but can I legally get that information for proof in court?

Do I get pictures and a written contract/letter that the quad was repo'd for failure of "previous owner" breach of contract?

I am suing for the amount I paid him (2500). Can I also sue him for the amount of the background check I had to buy to get his address and phone number since he lied about his location?

Any other ideas would be helpful and greatly appreciated.

I have bill of sale .. and the quad has a vin number and the bank has the account on file still.

It's going to be very difficult since ATV's aren't registered with the DMV and therefore do not require a title and or tag. Small claims court is going to be your best bet. I hope you have a bill of sale or some type of sales agreement from this guy! Good luck.

You can sue him for your damages and your expenses such as filing fees, service fees and reasonable expenses to locate him.
