Divorces are expensive and they ruin your credit. If you have children involved you will most likely be forced to pay child support. See if you can get a simple divorce if you have no children and no assets...but if you have assets, debts and kids you will have to pay the big $$$. You can divorce your wife at any time...divorce is now no fault.

If you have no kids or shared assets all you have to pay are court costs, However you can only file if you have been seperated for 5 years, you can file after two years apart only if she agrees.
A better reason to give is unreasonable behaviour, however it would need to be with in the last 6 months to count.

If you've truly been apart 3 years I'm pretty sure you can go file. Laws vary state by state, but I know a lot of people here in NY separate for 1 year so the divorce process is cheaper.
I'm not sure what the exact logic is, whether it makes it uncontested, provides grounds, or whatever, but I do know it's a common practice. My sister went through it, but ended up not waiting the full year for whatever reason. My brother is doing it now, his year is up in February.
I'd suggest talking to your lawyer.

The down side is since your still married>All her bills she has acquired can be your responsible also>Since she refuses than it 's contested so you will have to get a Attorney>Call and get the answers>The longer you wait the more she will be entitled to>Every thing you own & have aquired since you married her>>

you can divorce her yourself, just get the papers from the courts fill them in yourself, i beleive theres a fee for filing. then send her a copy yourself or the courts.
