Our neighbors sewer line goes under our house. This dates back to the 50s when the developer of both lots took a shortcut with the sewer line. One of our toilets, and old unremodeled bathroom, is on that particular sewer line. They are constantly plugging the toilet (we never use that bathroom). Now they are telling us that we have to pay for the line to be cleared.

I was wondering if it was their responsibility to have their sewer line updated and run to the street, instead of under our property. Seems to me that their poop is trespassing on our property.

Where is the main city sewer line located ? If they are at the end of the line meaning the flow is from them past you folks to the city line someone at the city office has to inspect what is taking place and make or have the neighbors correct the line flow. The city inspector at the time had to approve of the way the line was run or didn't inspect it at all, which you should go after them to correct the problem. It really doesn't matter nor should you let it go that you don't use that bathroom. The day will come when there is no one at home and the line plugs up and the whole house is involved. Has happen yet, don't wait for that day because it will happen when you have other things to do besides clean up a smelly flooded house.

If you never use that toilet...then remove it, cap that drain pipe...and tell them to have a great day! They may get the idea it will be easier to run a new line then to fight to the death. If the line is from the 50's it's just about shot anyway. It's more then likely clay and has roots running through it. If they really want to know, they can hire a company to run a camera down the line. That will show the flaw...

Call the poop patrol. They should be at least as responsible as you are. Maybe if you sit down and explained your side of the story to them, you could work out something to both of your advantage. It would probably be cheaper than going through the courts.

Try calling your local building inspector or code enforcement office. They might be able to give you more information. If you aren't using the line then I'd have to say that you certainly aren't responsible for getting it fixed when it stops up.
