My husband has cheated on me and I need to hire a lawyer in order to protect my interests and those of my son... but I don't have any money. My husband made the money and I stayed home with our son. Recently he'd told me to leave the house so I left with our son and moved in with my parents. We didn't have any savings and there's barely anything left in our checking account (he's still left me on our joint checking account so that I can withdraw money as needed to pay for food or clothing, etc).

We've been married about 3 and a half years. Our son is 2 years old and I'm also worried about custody. I live in Arizona, the Phoenix area. Is my best bet to go through friends and to see if they can find a lawyer they know who would take me on pro bono, or are there free services out there for people like me that I've never heard of?

Hi ZC :)

I looked up the Arizona Bar Association's website and found this -- its a list of lawyers who work pro bono or offer their services at a reduced cost. Hope it helps you!

I got my divorce and custody pro bono. In Massachusetts lawyers have "office" hours once a week at the courthouse. They take on pro bono cases. The program is called Lawyer of the Day.

A call to your courthouse should let you know if anything like that is done in Phoenix.

Having left the house already puts you at a disadvantage. Call lawyers NOW, explain your situation and ask if they will take your case and make the husband pay for the attorney services. This is done all the time. Keep calling around until you find one who will. It is IMPERATIVE to do this NOW. The actions you take will figure into the final resolution. For example, you could be characterized as having "abandoned" the marital home and get nothing from it.

you can look up legal aid in your local phone book or online but any attorney there should be willing to consult with you and help you take the next step. The fact that he told you to leave the house and you did could be considered abandonment unless it was because you feared what he may do to you or your son if you did not leave and that fear for your son may influence any fight for custody as well. A good attorney may be able to get the house for you and child support as well. good Luck to you!!

i'm sorry to hear about your troubles. here's an idea:try legal aide. that's how i got my divorce. all i had to pay was $20 for the name change. they only handle simple divorces, i.e. non-contested. you can go to your juvenile and domestic court and file for physical custody and child support also. so look in the phone book for legal aide society and give them a call so you can see what can be done. good luck

You could possibly find a lawyer who is willing to take some percentage of the potential settlement.

check the phone book for the public defender's office. in certain cases, there are lawyers that donate their time. call the health department for your county, they may be able to steer you in the right direction.

There are pretty cheap "divorce kits" all over the internet that will allow you to do the divorce yourself. Typically, the largest fee incurred is that of getting the documents recorded at the county. I don't know what the laws are in AZ regarding community property, etc. so be sure to do as much reading as you can to protect any interest you may have as far a assets are concerned. If he has expressed interest in keeping the child, then you do indeed have a custody issue to remedy and will need to have attorney representation; perhaps a loan from your parents can get you the help you need to see this thru. There is also the issue of fault or no-fault divorces that could aid in determing the custody issue. Again, you need to do some research for your state. Good luck!

Ask a lawyer... make a few phone calls. Lawyers will know how to get you connected to a fee-free or affordable service.
