Im 19 years old and need to be emancipated from my parents. Im still under my adoptive mother even though Im past the age of 18 because I never filed for my taxes and a few other techincal things that many people dont realize,but your not fully out of underneath your parents until your 21 birthday.My step father tried to rape me. My mother walked in and started calling me all kinds of names then she attacked me. I had a bruised, swollen eye,& a cut on my face. I was then thrown out on the streets. This all happend Thursday. Ive been living on the streets since then. spending my days in the library and my nights on the park bench. Ive thought about pressing charges but no one will belive me. I have NO EVIDENCE because it was only attempted rape. And my step father is a pillar of the community. Im also afraid of what my family and his will say. They all think I'm lying. I just want to get emancipated so that I can start college. I cant do that while im still under my mother. PLEASE HELP!

Emancipation is of a minor 14-17 - you are 18. I don't know this applies to you or not.

In order to get emancipated, you have to have parents' consent and go in front of a judge. It's not likely for a judge to give the consent. You must have a job, transportation, schooling, a place to live, etc. If you have all those things and a good reason on emancipation you may get the consent from the judge.

The minor would have to prove both that emancipation would be in their best interest (which means they must have a valid reason for it) and that they have the ability to fully support themselves. There could be other requirements as well. Some states require parental consent to the emancipation. And not all states have an emancipation statute. Generally speaking, emancipation is not a quick or easy process and more often than not it is denied

If you meet the requirements for emancipation you can. The basic requirements are: you must be able to fully support yourself (rent, utilities, food, etc) *without any assistance* and you must convince the court that it's truly in your best interest to be emancipated. That means you must have legitimate, valid reasons. Just not getting along with your parents or wanting more freedom is not going to be enough. Additional requirements vary by state, however, not every state has emancipation laws.

Start Living Independently, if required leave the City and go to another unknown city and start your life again.

You can't. You're already of legal age so emancipation isn't possible.

It has NOTHING to do with filing taxes, just birthdays.

Report the assault to the police. Go to a women's shelter; they can and will help you. It's time to get out of that environment and stay out.

If i were you I would call a crisis hotline where you could get support and help and you do not even have to tell the operator your name.
