Stop: Take a breath --- Now think and write a dollar amount down --- exactly how much are you willing to pay to obtain your child? How much is your child worth to you?

Now --- is that sum bigger that an attorney fee?

GET AN ATTORNEY --- Attorney's may have a bad reputation :-O --- but most have passed a bar exam and two of those questions Are: [Write a brief of No More than 500 words (900 if you use Microsoft word :-( on the following]

When can an licensed attorney get human blood out of a turnip? When should a licensed attorney in the great state of [name of state] quit beating a dead horse?

Most attorneys have passed both of those questions [with the possible exception of a divorce attorney :-)

So they will know your financial situation -- They are out to help you --- but remember I am not an attorney.

You need an attorney.

The family may or may not go to court to change custody. There may or may not be a Will to probate, there may or may not be assets. It's possible the ex-in-laws may just start raising your child without any permission of a court. If that happens, you will likely be sorely tempted to commit a felony, as it is possible to be guilty of kidnapping your own son. I don't recommend that.

Regardless of who initiates the custody suit, you need a lawyer. The stakes are too high to gamble on an understanding judge. It's theoretically possible that the judge will give you all the guidance you need, but it's also possible that they won't. I wouldn't risk it.

Most of the time, non-custodial parents are awarded custody of children when the other parent dies. If you are in need of an attorney in this situation - I suspect there is additional information you are not telling us.

Get an attorney. Is this rocket science? Affordable? This is your kid. You do what you have to do. End of story.
