this is not in my contract but is in a contract between companies A & B. A sold off company B, I was transfered to Company A but I wish to work for company B.

Not your problem .. the 'non-poaching' clause applies to co. B ..

If they (B) offer you a job whilst you are still employed by Co. A, then THEY (B) have to 'get out of the clause' .. in practise this means B will have to pay compensation to co. A.

The only case I have ever come across involved a Temp. worker from an Agency. The Company paid the Agency 1 years salary to 'release' the Temp from the Agency into a Permanent job at the Company.

Leave company "A". Then "Apply for a position" with company "B".
They haven't poached you then.
