I am a parttime photographer at a retail store. I only work about 20-24 hours a week. They've had a problem with me ever since I've started because I can only work certain days--I'm a stay at home mom the rest of the time. I've been working at this company for a year and a half and 12 people have quit at my studio. I feel like I'm being discriminated against. I am the only one my boss bothers about my schedule, sales, and other various things. And obviously I'm a loyal person and a damn good photographer, I just love what I do.
He claims that the DM is going to cut an hour of my pay because she saw no reason why I was at work past my scheduled time. I WAS WORKING! I don't think it matters, I'm not getting overtime wages and I've never been told it wasn't okay to work past my scheduled time. I told him it was against the law to take away an hour I actually worked. I am going to call the EEOC tomorrow and file a complaint. What would you do?

I live in Indiana. And I hate being treated this way, but I'm trying to keep my job as long as I can, then find a reason to sue for unemployment compensation. I'd love to work at another studio and will be contacting one tomorrow to see if they're interesting in taking on a parttimer with limited availability.
Also, I did tell the hiring manager at the time I was hired about my availability and she quit three days after I was hired...OOPS!

That depends upon how much you like the job. If you create waves or file a complaint they may find a reason to get rid of you. I think I would try to find another job, and watch to see if they do that again, or if there are no photography studios in your area, consider getting a loan to start a studio of our own where you could have the kids with you and make far more money working for yourself.

Since you didnt mention which country your writing from I'm not sure how to help you from a legal aspect. I do know for a fact that if you work beyond your scheduled time, the employer has the right not to pay you for the time worked over your scheduled shift. Regardless of if you were working or not, technically the employer must grant permission for the time worked beyond the scheduled shift in order to be payed for it. But since they have never said (i trust) that you cant stay late, in which case someone - management- should have relieved you from your duties so you could go home. If that never happened, then they cant really complain.

But I definatly think you need to file that report, regardless of how you feel tomorrow, there is a reason why you have such a high turn over staff.. I wonder how many times they've done this to other people and made them quit?

And if you told them from the begining that you were interested in flexible, part time work, and you told them your availability, I really cant see why they would hire you expecting more then that... but then some management, as we've seen are just plain stupid. FILE THAT REPORT!!

You seem to be under the impression that your limited availability is your "right" and they have to bend to you whim. That's wrong - they may know about them, but that does not mean that they are bound by law to them.

As for the time you elected to work after your scheduled shift - if this was not pre-approved by a manager or other person authorized to make schedule changes then you are the one in the wrong. Sorry- that is just the way it is. Your schedule is set by your boss, and when they say you end at X time then you do not get to say "nah I want to work an hour past that". Just like you cannot leave an hour before your shift ends and expect that to be okay.

not joking, real answer: If I was a woman, I would use the "discrimination because I am a woman" statement, and maybe throw in some "male harassment" complaints for good measure. yes, I would be a very evil @#$%& to make sure I got treated right at work!

They set the schedule, not you.
Go ahead, file a complaint. Quitting time is quitting time, they set it, not you.
If the complaint is found to be without grounds, you could end up being fired.

Contact your local labor board. They will know what to do. I could tell you but things are different from state. So save some time and heart ache contact your labor board.

as long as you're honest, it's your right to demand.but if your boss do it every time you do overtime,you better stop working overtime coz its useless.you're just wasting the time you should have spent with your children/family.it's better to avoid misunderstanding than to face problems you can avoid to happen/appear.save the energy you'll be using in arguing to fight for your right,use it for your family instead I'm sure they'll be happy.

yOU LOVE YOUR JOB... THATS FANTASTIC,, U OBVIOUSLY HAVE much experince SO i suggest you tell your boss how you feel and if things dont change tell him you will find a different place where your effort is appreciated. About that hour... girl you better raise hell for it because they have no right to walk on you like a doormat! DONT LET THEM PUSH YOU AROUND! YOU KONW YOUR WORTH MUCH MORE THAN THAT!
